TCPA and compliance for real estate cold calling

Compliance is a process you can inspect, not a line in a contract. Here is what the rules cover, how we operate within them, and the questions to ask any vendor. This is general information, not legal advice; a compliance attorney is the right call for your specific situation.

In this guide

What the rules cover

The federal Telephone Consumer Protection Act and state equivalents regulate calling hours, autodialed and prerecorded calls, the National Do Not Call Registry and internal do-not-call lists, caller identification and call recording consent. Several states add their own registries and tighter hours. Rules change; a vendor should be able to say what changed in the last year.

How we operate

  • Calls placed only within permitted hours for the recipient's local time
  • Opt-out and do-not-call requests actioned immediately and logged, and the number suppressed across the campaign
  • Caller identifies themselves and the purpose of the call
  • Every call recorded, with recording handled according to the applicable state rules
  • Contact records retained per campaign
  • Every specialist with access to your data signs an NDA; access is role-limited and revoked on offboarding

What to ask any vendor

How opt-outs are recorded and how fast suppression happens. Which hours they call by state. Whether they scrub against the National DNC and how often. Whether calls are recorded and where recordings are stored. Who has access to your data. Ask for the written process, not a verbal yes.

Why this protects you, not just them

Liability in outbound calling can land on the business the call is made for. A vendor's process is your exposure. Inspect it before you sign, not after a complaint.

Questions people ask

Do you scrub against the Do Not Call registry?

Scrubbing is configured per campaign on the scoping call so it matches your compliance posture. Opt-outs received on calls are suppressed immediately regardless.

Are calls recorded?

Yes, and available to you. Recording is handled according to the rules of the recipient's state.

Is this legal advice?

No. It's an operator's description of the rules and our process. For your specific exposure, talk to a TCPA attorney.
